Sourabh Mishra

Sourabh Mishra's practice includes complex commercial litigation, internal investigations, and white collar defense. Mr. Mishra has represented individuals and companies in complex commercial litigation matters across a wide array of industries, including medical devices, information analytics, food and beverage, telecommunications, and biopharmaceuticals. Mr. Mishra also regularly represents individuals and corporations in connection with complex and sensitive internal investigations and governmental inquiries, including the City of Santa Monica, the officer of a public company, a prominent senior executive at an investment firm, and a health insurance company.

Prior to joining Hueston Hennigan, Mr. Mishra graduated from Columbia Law School where he was Notes Editor on the Columbia Law Review. During law school, Mr. Mishra spent his first summer working at the U.S. Attorney's Office in the Eastern District of New York and externed during his third year for the Honorable Debra A. Livingston on the U.S. Court of Appeals for the Second Circuit. Before law school, Mr. Mishra worked as a legal analyst at Soros Fund Management in New York City.

LITIGATION EXPERIENCE

  • Transcend Medical, Inc. v. Glaukos Corporation: Our firm was brought in three months before trial to defend against a claim of inequitable conduct in a complex patent matter in Delaware federal court. Mr. Mishra participated in all aspects of the pretrial preparation, including assisting in preparing several fact witnesses for their direct examinations and managing the list of exhibits to be used at trial. The case settled three days before trial on favorable terms for our client.
  • Information Analytics Company: Mr. Mishra was trial counsel at a confidential arbitration for an information analytics company in a business dispute which included claims of breach of contract. Mr. Mishra was heavily involved in all aspects of the arbitration, including second-chairing the direct and cross-examinations of eight witnesses, preparing direct and cross-examinations, developing the closing argument presentations, and helping draft the post-arbitration briefing. Mr. Mishra also participated in all aspects of the pretrial preparation, including assisting in preparing fact witnesses for direct examination.

INTERNAL INVESTIGATIONS

  • City of Santa Monica: Mr. Mishra was the lead associate on and supervised an investigation for the City of Santa Monica regarding a review and assessment of allegations of unethical conduct by public officials and the efficacy of an anti-corruption municipal statute. Mr. Mishra was critical in drafting and developing a best practices report that was ultimately submitted to the City with specific recommendations for changes to the rules and procedures in the City, and suggested amendments to the municipal anti-corruption law. Mr. Mishra was vital in all parts of the investigation, including reviewing preliminary materials, developing and organizing witness interview lists, and conducting witness interviews.
  • Officer of a Public Company: Mr. Mishra is currently representing an officer of a public company in an investigation being conducted by the Federal Bureau of Investigation and Securities and Exchange Commission.
  • Prominent Senior Executive: Mr. Mishra is currently representing the managing director at a global investment firm in a multi-year investigation being conducted by the Securities and Exchange Commission.
  • Health Insurance Company: Mr. Mishra assisted in an internal investigation for a health insurance company which was in a dispute regarding a critical contractual interpretation and potential fraud.
