Michael J. Stephan has a broad-based corporate practice with particular emphasis on securities fraud, antitrust, contract disputes, and governmental investigations. Mr. Stephan has represented clients in state and federal courts at both trial and appellate levels, and also has extensive experience in the areas of intellectual property, identity theft, and white collar defense. Mr. Stephan also devotes substantial time to pro bono representation.

Mr. Stephan has considerable courtroom experience, which most recently includes a week-long federal jury trial in the Eastern District of Texas, in which he successfully cross-examined the corporate representative of one of the top ten consumer electronics companies in the world, and argued (and won) several key evidentiary motions. The jury returned a unanimous verdict in favor of Mr. Stephan's client, and awarded his client the maximum damages amount sought by Mr. Stephan.

Mr. Stephan began his legal career as a law clerk to the Honorable Cynthia Holcomb Hall of the United States Court of Appeals for the Ninth Circuit. Prior to joining the firm, Mr. Stephan was an associate at Irell & Manella LLP. He earned his J.D. from the University of Texas School of Law, where he was an Articles Editor for the Texas Law Review and a Chancellor-a member of Texas Law's most prestigious academic honor society.

Mr. Stephan has authored several legal publications on topics including criminal law, constitutional law, and environmental law. He enjoys trail running and rock climbing.

  • Secured unanimous jury verdict for plaintiff in patent infringement case against global manufacturer of mobile phones, and won ten-cent-per-unit royalty award, which was full amount of damages sought by plaintiff. [see " Hueston Hennigan Prevails in Jury Trial Against LG"]
  • Secured summary judgment for plaintiff in securities fraud case based on violations of blue sky law, resulting in complete unwinding of $25 million sale of securities.
  • Represented identity theft victim in multi-jurisdictional, pre-litigation conflict resolution resulting in favorable settlement of all claims.
  • Successfully defended board chairman of financial company under investigation by Securities and Exchange Commission for fraud in the sale of securities within high-profile investment fund.
  • Successfully defended medical device company against multi-jurisdictional antitrust litigation, which resulted in favorable settlement of all claims.
  • Represented CEO in executive compensation negotiation, leading to renewal and improvement of CEO's employment contract.
  • Represented co-founders of world's largest electronic dance music company in contract dispute, which resulted in favorable settlement of all claims.
  • Representing individual under investigation by Department of Justice and California Attorney General's Office for antitrust violations related to television industry.


  • Represented non-profit corporation in criminal and civil litigation stemming from embezzlement of funds by corporate officer.
  • Obtained Special Immigrant Visa for Afghan refugee and translator for U.S. Special Forces in Afghanistan.
