Brandon Marsh’s practice is focused on complex, high-stakes business litigation, including class actions, securities litigation, intellectual property litigation, contract disputes, mass tort, and employment matters. He has represented both plaintiffs and defendants in all phases of litigation in federal and state courts, at both the trial court and appellate levels.

Mr. Marsh has extensive experience litigating class actions and mass tort actions, on both the plaintiffs’ side and the defense side. He has defended several class actions brought under the federal securities laws and federal and state consumer protection laws. Prior to joining Hueston Hennigan, Mr. Marsh was a Director at Saxena White P.A., where he led class action litigation teams on behalf of institutional investors seeking to recover losses under the federal securities laws. Mr. Marsh has helped investors recover over $750 million in securities class actions and direct opt-out actions. Significant recoveries include In re Cobalt International Energy, Inc. Securities Litigation ($389.6 million – the largest securities class action recovery of 2019), In re Genworth Financial, Inc. Securities Litigation ($219 million – the largest-ever securities class action recovery in Virginia federal courts), and In re Rayonier Inc. Securities Litigation ($73 million). Earlier in his career, Mr. Marsh was a senior associate at Irell & Manella LLP, where he represented clients in a variety of high-stakes business disputes and complex litigation matters.

Mr. Marsh has authored numerous articles relating to class actions, arbitration, and the federal securities laws. His articles have been published in The NAPPA Report, Pensions & InvestmentsLaw360 and American Bar Association periodicals.

During law school, Mr. Marsh served as an editor of the Stanford Law Review and was a teaching assistant for Federal Pretrial Litigation, and to Dean Larry Kramer.

Mr. Marsh speaks German, French, Spanish, and Portuguese.

Experience

Won “the largest-ever U.S. trademark awards” (Reuters) for Monster Energy Company against rival beverage company Vital Pharmaceuticals, Inc. Following a two-week trial, the arbitrator held that VPX’s Bang Energy does not contain advertised muscle-building creatine and infringed on “Bang” trademark. In the significant ruling, the arbitrator awarded Monster and Orange Bang $175 million in damages, nearly $10 million in attorney’s fees and costs, and a 5% royalty on all future sales of Bang Energy (with over $1.5 billion in annual sales). Obtained a favorable settlement, after a week of trial, for Synchrony Financial (formerly GE Capital) in a lawsuit involving breach of contract, fraudulent misrepresentation, and alter ego claims.

Obtained a favorable settlement, after a week of trial, for the country’s largest integrated health care system in a lawsuit brought by a group of California hospitals seeking hundreds of millions of dollars for emergency medical services provided to its members.

Obtained a favorable settlement for CoreLogic Credco, LLC in a consumer class action lawsuit alleging violations of federal and state credit reporting laws.
