In a major victory for the Navajo Nation on Monday, the Court denied Defendants Environmental Restoration LLC and Weston Solutions Inc.’s separate motions for summary judgment seeking to dismiss the Navajo Nation’s tort claims arising out of the 2015 Gold King Mine disaster.
“The Court’s thoughtful Order ensures that the USEPA’s contractors who triggered the toxic Gold King Mine spill in August 2015, along with the USEPA, will not escape before trial by claiming refuge under their status as government contractors,” said partner Andrew Walsh.
