Walsh and Reiter Named to the List of 2022 Visionaries

Mr. Walsh represents clients in complex civil business disputes, high-stakes environmental and entertainment litigation, and white collar criminal actions, in both state and federal court. Editors noted that he recently secured two declinations in high-profile criminal investigations, as well as his representation of the Navajo Nation in federal multi-district litigation against the USEPA, its contractors, and mining companies for damages arising out of the unprecedented acid mine wastewater spill from the Gold King Mine near Silverton, Colorado in August 2015. His determined strategy has led to a recovery of more than $40 million to date for the Navajo Nation with the latest USEPA settlement in June 2022.

Mr. Reiter, recently recognized by Law360 as a Rising Star, is counsel on many of the firm’s highest-profile trials, having played a key role in six trial/arbitration victories to date. Navajo Nation Recovers More Than $40 Million to Date For Historic Gold King Mine Spill Disaster with Latest USEPA Settlement

The settlement follows extensive discovery and motion practice over the last six years during which we defeated the United States’ numerous attempts to dismiss the Nation’s claims based on sovereign immunity and other defenses. The USEPA and its contractors caused the unprecedented disaster, which released millions of gallons of toxic acid mine waste into the waters upstream of the Navajo Nation, when they recklessly excavated into the abandoned Gold King Mine in disregard of highly pressurized conditions inside. Discovery revealed that the backup USEPA On-Scene Coordinator threw out the work plans and directed excavation into the face of the plug holding back the water.

Last year, on behalf of the Navajo Nation, we won a motion for sanctions against the USEPA for destroying evidence. To date, Hueston Hennigan has recovered $41 million dollars on behalf of the Navajo Nation, and trial is set for November 2022 against two USEPA contractors.

“This settlement is an important victory for the Navajo Nation and holds the United States accountable for its role in causing this disaster,” said Hueston Hennigan partner Andrew K. Walsh. “It is the most significant step yet in our commitment to obtain full and fair compensation for the Navajo Nation.”

Reiter Named “Rising Star” for Trials by Law360

In an interview with Law360, Mr. Reiter discussed the victory he obtained for Amazon.com in a suit brought by eBay, alleging an international racketeering and fraud conspiracy to poach top sellers from the online auction platform. While this was a “tough case factually, with many defendants and many causes of action,” Mr. Reiter and the Hueston Hennigan team prevailed on all claims.

Mr. Reiter also discussed the complete defense verdict he secured for PricewaterhouseCoopers against a whistleblower who had reported to the SEC. “I think we disproved the plaintiff’s narrative and completely flipped it on its head,” Mr. Reiter said. PwC “had, in fact, encouraged the plaintiff to raise any concerns,” and Hueston Hennigan was able to “vindicate the reputation of a client who had had these horrible things alleged.”

When asked what motivates him, Mr. Reiter said “first and foremost, delivering results” for his clients. He went on to say that clients place a great deal of trust in the firm, and he aims to exceed their expectations, especially “when reputation and significant exposure is on the line.”

Mr. Reiter also likes working with “some of the best trial lawyers in the country,” and says he finds the “the intensity and high stakes [of trial] enlivening.” “When you’re in trial, you’re singularly focused on winning the case before you,” he said. “That gives me an adrenaline rush that I think brings out my best work.”

A team of Law360 editors selected the 2022 Rising Stars winners after reviewing more than 1,350 submissions. Attorneys had to be under 40 as of April 30, 2022, to be eligible for this year’s award.
